Activision Sued for Guitar Hero III Mono Audio

Activision recently announced that they would be sending out remastered discs of Guitar Hero III to Wii owners. Even though the box claims that it has Dolby Pro Logic II surround sound, the game’s audio is actually in mono. The promised discs are not expected to be available until early 2008.

One consumer didn’t wait until 2008 to take action. His name is Samuel Livingston of San Diego, California. He filed a class action lawsuit against Activision claiming consumers “would not have purchased the Guitar Hero III video game and/or paid as much for it had they known the truth about the product.”

The lawsuit “seeks actual damages, individual restitution, equitable relief, civil penalties, costs and expenses of litigation, including attorney’s fees, and all further relief available.” According to the lawsuit, Activision continues to engage in deceptive practices by selling Guitar Hero 3 for Wii at retail stores.
